License Agreement / Terms and Conditions
Magic RL Brown/Home Builders Marketing Inc., the Grantor, here by grants a limited
license for the use of Magic, its proprietary housing information database application
and the housing market information associated with it for a period starting
and ending with the volume numbers associated with the invoice
plus applicable sales tax, to be paid by credit card or within 10 days of receipt of an
invoice for same by the undersigned to RL Brown/Home Builders Marketing Inc.
The undersigned Licensee agrees with the
following terms and conditions of this license:
1. This license allows the Licensee use of the application and associated data for
a period of 30 days for each monthly dataset provided to the Licensee by the Grantor.
2. This license allows the Licensee 5 individual user access emails unless otherwise agreed upon in advance;
3. This license allows the Licensee to generate reports and extract data from the
associated data bases for his private use only. No resale of any data, reports,
graphics, or other information generated by the program and application is authorized
under this license.
4. The licensee agrees that he will not make copies of or reverse-engineer the application or associated
data, share his unique log-in or password or allow other parties to use or make copies of the application or associated
data.
5. The Licensee understands that a violation of the above provisions will cause
the Grantor of this license to suffer financial harm and will result in legal action
for the recovery of damages, including punitive damages, and the cost of legal action
by the Grantor of this license.
Licensee understands that this is a legal agreement by and between the parties
and that this Agreement will be construed under the laws of the State of Arizona.
This Agreement will remain in force through subsequent renewals of the Licensee’s
subscription to the application and supporting data and does not cease with
the expiration of the subscription.
All data is propriatary to RL Brown Reports/Home Builders Marketing Inc.,
and all rights regarding republishing or redisribution remain in force beyond the subscription period.
